ARREST OF JOAS LEADERS IN SARAWAK ON PENAN ISSUE

As Malaysia commemorates its 46th anniversary, 15 indigenous Sarawakians have been detained by Kuching police for trying to send a memorandum of protest to the Sarawak Chief Minister.

Among those arrested are Mark Bujang (BRIMAS), Raymond Abin (BRIMAS) and Hellan Empaing (WADESA), all leaders of the Jaringan Orang Asal SeMalaysia (Indigenous Peoples Network of Malaysia) as well as representatives from the Kayan, Kenyah and Penan communities of Sarawak.

 

The contingent, consisting of 6 Penan, 4 Iban, 2 Kayan and 3 Kenyah are all representatives of communities who will be affected by two major dams which are being built in their areas. They had prepared a memorandum on the issue and were delivering it to Wisma Bapa Malaysia, the office of the Chief Minister. While waiting for endorsement of the document, they were arrested by local police. They are currently being held in the Kampung Gita Police Station in Petra Jaya, Kuching, Sarawak. It is uncertain whether they are being charged, or what reasons are being given for their detention.

Jaringan Orang Asal SeMalaysia strongly condemns the detention of its members who were attempting to deliver a memorandum on behalf of the indigenous peoples of the Baram and Murum areas of Sarawak. The memorandum protested the State Government’s actions to build hydro electric dams in these areas without the free, prior and informed consent of the communities affected and without due regards to the status of the native lands involved. The actions of the State Government are in clear contradiction to the UN Declaration on the Rights of Indigenous Peoples, which Malaysia strongly supports.

We also condemn the use of arrest to intimidate and silence the voices of the communities who are questioning the construction of large dams on the area. This demonstrates the unwillingness of the State Government to ensure the full and effective participation of indigenous peoples in projects that affect them.

We call upon the Sarawak State Government to immediately release all fifteen Sarawakians and engage in a proper consultative process with the affected communities. We also call for the respect of the constitutional native land rights of these communities. It is also in violation of the right to peaceful assembly, guaranteed under Article 10 of the Federal Constitution.

Nude woman escapes being raped in Sandakan

A woman was stripped naked behind some bushes by a man posing as an enforcement officer but escaped being raped when the man fled after hearing sounds of people nearby.

The man had abducted the 28-year-old woman and her sister from their car outside a supermarket on Sunday night.

The sisters had parked outside the supermarket when the man, identifying himself as an enforcement officer, suddenly got into the car and directed the woman to drive to a secluded area in Jalan Cecily here.

He then fondled and molested her and assaulted her when she tried to put up a struggle .

He dragged her out of the car towards some bushes and stripped her while the terrified sister was warned not to make any sound.

Just then, the man heard people walking near the car and he fled.

The woman has lodged a police report on the incident.

Sandakan police chief Asst Comm Rosli Mohd Isa confirmed the case.

Woman flees rapist stepdad but ends up as sex slave

A TWENTY-ONE-year-old woman, who had run away from home after being raped by her stepfather, ended up being a sex slave to a stranger.

She left her village in Kelantan last month, hoping to put the past behind and for better days ahead in Kuala Lumpur. But her search for a job as a shop assistant led her to an even bitter experience.

During her job hunt, she met a stranger in Rawang and followed him home, thinking he was a good Samaritan who had offered to provide her with shelter.

Harian Metro, quoting a source, reported that she was instead locked up in the house and raped repeatedly for a month.

On Wednesday morning, she managed to escape from the house in Bukit Permai, Ampang, when her captor was fast asleep.

Police are hunting for the suspect.

Dokumen kes ibu Manohara, Daisy dibongkar?

Blog – yang sering mempertahankan seorang putera Sultan Kelantan – mendedahkan beberapa dokumen yang didakwa menunjukkan ibu Manohara Odelia Pinot pernah lari daripada kes mahkamah di Perancis.

Truth Appeared, blog yang menerbitkan siri foto peribadi Manohara dengan suaminya Tengku Muhammad Fakhry Petra sejak April, semalam menerbitkan 25 halaman dokumen satu kes di mahkamah majistret.

Satu sumber yang dekat dengan kerabat diraja itu, ketika dihubungi Malaysiakini, berkata dokumen yang didedahkan “100 peratus benar”.

Dokumen-dokumen itu yang asalnya dalam bahasa Perancis, diterjemahkan ke bahasa Inggeris oleh Pusat Bahasa Perancis di Kuala Lumpur, dipercayai dibuat baru-baru ini.

Dokumen terjemahan itu menyatakan, antaranya, ibu bekas model muda itu Daisy Fajarina tidak pernah menghadiri kes tersebut dan didapati bersalah dengan hukuman penjara 18 bulan.

Beliau didakwa gagal membayar pembantu rumahnya, seorang warga Indonesia bernama Shaliha Lanti, sewaktu tinggal di Nice selama tiga tahun sejak 2004.

Waran tangkap

Dokumen yang sama menyatakan waran tangkap dikeluarkan terhadapnya pada 26 Jun 2007.

Blog itu juga mendedahkan beberapa siri dokumen mahkamah itu, antaranya laporan-laporan perubatan dan sosial Shaliha serta kertas pertuduhan terhadap Daisy.

Menurut dokumen itu, mahkamah daerah Grasse juga mengeluarkan perintah supaya polis mencari dan memenjarakan Daisy mengikut peruntukan undang-undang negara Eropah itu.

Suaminya ketika itu Jurgen Reiner Noack-Pinot turut didapati bersalah melakukan serangan seksual terhadap bekas pembantu mereka itu pada awal 2007 dan dijatuhkan hukuman empat bulan penjara.

Mahkamah juga memerintahkan Daisy dan dan Noack-Pinot membayar sebanyak 16,000 euro (RM79,600) sebagai ganti rugi terhadap Shaliha, kini berumur 25 tahun.

Shaliha sebelum itu dalam aduannya kepada polis di Perancis mendakwa menjadi mangsa penganiayaan majikannya – menyebabkan beliau sakit kepala, lengan dan bahagian bawah tubuh, perut dan pinggul, paha serta mengalami kejutan psikologi.

Laporan perubatan

Laporan perubatan Saliha yang dikemukakan kepada mahkamah mengesahkan terdapat beberapa kecederaan di tubuhnya serta menderita kejutan psikologi yang serius.

Peguam Manohara di Malaysia, Mohamed Zaini Mazlan ketika dihubungi enggan mengulas perkara itu.

Manohara dan Daisy sering melemparkan dakwaan Tengku Muhammad Fakhry pernah mendera isterinya.

Bagaimanapun putera Sultan Kelantan itu menafikan semua dakwaan tersebut, termasuk yang terbaru melalui stesen televisyen republik tersebut, TVOne, semalam

Dalam rakaman temubual ringkas itu, dipercayai di Malaysia, Tengku Muhammad Fakhry mempertikaikan dakwaan Manohara pernah diseterika di bahagian leher dan mengingatkan Manohara bahawa dakwaan negatif boleh menggugat peluang isterinya mendapat pekerjaan.

Teenager gang-raped & made sex slave for 12 days

A TEENAGER who took up an offer by four strangers to send her home was gang-raped by them for 12 days in a house in Kuantan, reported Sin Chew Daily. The four men had approached the victim, aged 19, after she and a friend whom she had watched a movie with at a Kuantan shopping mall on June 5 went separate ways. Kuantan OCPD Asst Comm Mohd Jasmani Yusoff was quoted by the daily as saying that the men offered to send the girl home to Pekan. The victim, who did not suspect anything amiss, accepted the offer. The men took her to a house in Kuantan instead where the girl claimed she was confined in a room for 12 days, during which the men took turns to rape her. She only fled the house on Tuesday when the men fell asleep before lodging a report at the Kuantan police station. Police have identified the suspects who are aged between 16 and 36.

Boss raped me, says shop assistant

KUANTAN: A 17-year-old shop assistant has claimed that her employer raped her in his house in Raub on Monday.

According to state CID chief Asst Comm T. Narenasegaran, the victim believed that the employer was sincere in wanting to send her back to her hostel after the shop, located in Simpang Kallang, closed at about 11.45pm.

“However, on the way back, the employer made a detour and went to his house at Taman Amelina Letsari instead. He then raped her in the house,” ACP Narenasegaran said yesterday.

The suspect, 33, was arrested after the victim lodged a report the next day, he added.

In an unrelated incident, a 20-year-old man was detained in a shop selling handphones in Kempadang here on Wednesday in connection with illegal gambling activities.

ACP Narenasegaran said the youth was arrested in a raid following a tip-off.

Manohara claims she was raped during boat trip?

Indonesian teen model Manohara Odelia Pinot, 17, related the abuse that she alleges she suffered at the hands of her husband, Kelantan prince Tengku Muhammad Fakhry Petra, including ‘being raped’ during a boat ride from Singapore to Lombok, an island near Bali, Indonesia.

Her husband’s lawyer, Haaziq Pillay, declined to comment on the allegations, saying that Muhammad Fakhry had filed a report with the Malaysian police on the matter.

When did the abuse start?

Manohara: I don’t remember when. But it was not long before the wedding. I got raped, basically. I didn’t tell anyone.

I didn’t tell my mom. Tengku himself acted like it didn’t happen. I was just in denial. I went numb. I didn’t want to believe it.

We were cruising from Singapore to Lombok, to Bali. In the boat, he just grabbed me. At the time I was just in the room, sitting there to wait for my mom. Basically, it just happened. But after that, I just kind of shut down. I didn’t know what to think about myself. Basically, I was just in denial about the whole thing.

If he raped you before you went to Malaysia, why did you accept his invitation?

Because, (a) I just didn’t want to believe, so I just tried to completely block that out, and (b) after that he was really nice to me. He was extremely sweet and gentlemanly. I didn’t know what happened, actually.

Things got worse after you married him?

I know that March was the burn – I had an iron burn on my neck. And a cigar burn on my forehead. It was just random, he just came by with a cigar. I was ironing, and then he just took the thing. The iron came first. I took pictures of the scars with my BlackBerry. (photos below)

manohara odelia pinot body injuries 110609Between March and April, the mental and sexual abuse was constantly there. I was held there against my will.

They kept injecting me with several different medications to [make me] gain weight, to make me fall asleep and some to paralyse me.

It was emotionally and mentally exhausting to endure that.

When the whole razor [abuse] started, when things started to get real rough, that was in April. He took an eyebrow razor and cut me around my chest area.

The hardest thing about that was I was aware of it, I could feel it, but I couldn’t move or scream. I don’t know what he had given me.

I could see, hear him, smell him, feel him. I could feel the cuts on my body. It hurt. The physical pain, I didn’t mind too much. Just knowing that you have no control over anything and can’t do anything about it was just…

It happened three times. The first thing he marked on me was just a small X on my chest area. And the worst part about it is that he didn’t even slash it fast or anything. [He] just took his time, slowly. He looked as calm as ever. It’s like if you gave someone a paintbrush and told him to draw a flower. It took a little over 20 minutes.

Did he follow with sexual abuse?

Yes. It usually followed or happened beforehand.

Are you traumatised?

No, not traumatised. He’s taken so much from my life in the past, I’m not going to let him to take away my future. Someone once said, “Forgiving is freeing yourself.”
