Nizar berstatus ‘Rock Idol politician’ digantung hadiri sidang parlimen

Bubar Perak!Datuk Seri Mohammad Nizar Jamaluddin mencetuskan drama lagi sejurus selepas mengangkat sumpah sebagai anggota baru parlimen bagi Bukit Gantang pagi ini – melaungkan “hidup rakyat, bubar DUN”.

Dengan tujuan menarik perhatian ramai berhubung perjuangannya untuk menuntut jawatan menteri besar Perak, yang dirampas BN dalam pertukaran kerajaan pada Februari lalu, laungannya itu disambut pula oleh anggota-anggota Pakatan Rakyat dalam dewan tersebut.

Akibatnya, menteri besar Pakatan Rakyat itu diperintah meninggalkan Dewan Rakyat bersama enam lagi ahli parlimen pembangkang.

Yang Dipertua Dewan Rakyat, Tan Sri Pandikar Amin Mulia mengarahkan berbuat demikian atas dakwaan “berkelakuan kasar”.

Mereka bertujuh turut digantung daripada menghadiri sidang dewan selama dua hari.

Selain Mohammad Nizar, mereka yang mengalami nasib yang sama: Datuk Ngeh Khoo Ham (DAP-Beruas), Nga Kor Ming (DAP-Taiping), Datuk Mahfuz Omar (PAS-Pokok Sena), Dr Hatta Ramali (PAS-Kuala Krai), Dr Dzulkefly Ahmad (PAS-Kuala Selangor) dan N Gobalakrishnan (PKR-Padang Serai).

Mohammad Nizar bersama Nga dan Ngeh – kedua-duanya bekas exco kerajaan Pakatan Perak – antara pemimpin yang paling aktif dan lantang menuntut dikembalikan kerajaan yang mereka pernah kuasai sejak Mac tahun lalu.

Mohammad Nizar memenangi kerusi parlimen tersebut dalam satu pilihanraya kecil 7 April lepas setelah ia kosong akibat kematian wakil rakyat PAS di situ, Roslan Shaharum.

Court declares Zambry as Perak MB

The Court of Appeal has declared that Datuk Dr Zambry Abdul Kadir as the rightful Menteri Besar of Perak in a unanimous decision.

The decision set aside the High Court’s ruling that Datuk Seri Mohammad Nizar Jamaluddin was the rightful MB on grounds that a vote of no-confidence was not taken in the state assembly to remove him.

Rare but one appeal judge can decide?

MAY 12  – Get the conspiracy theory out of the way – fast.

It is not unprecedented for a single-judge Court of Appeal to hear an application for a stay of execution. It has happened before in Malaysia when time was of the essence and there was a shortage of appeal court judges on duty.

But it very rare for a single-judge Court of Appeal to grant a permanent stay of execution, say veteran lawyers.

What normally happens is that if a lone appeal court judge finds some merit in an argument by the appellants, he will grant an interim stay of execution, leaving the question of a permanent stay to a three-judge Court of Appeal.

This issue of a single-judge Court of Appeal arose today after newly-minted Court of Appeal judge Datuk Ramly Ali granted Datuk Zambry Abdul Kadir a stay of execution against a High Court declaration that Datuk Nizar Jamaluddin was the rightful Mentri Besar of Perak.

Justice Ramly said he satisfied that there were special circumstances to grant the stay as Zambry’s appeal against the declaration would be rendered nugatory if the stay was not granted.

“This is a very unique case as it does not only involve Dr Zambry and Mohammad Nizar but also the entire Perak state,” he said.

Ramly said that based on previous court practice, the court had jurisdiction to grant the stay order since a notice of appeal had been filed.

What surprised lawyers was the decision to appoint a single-judge Court of Appeal to hear the application for a stay of execution instead of putting the case before the three three-judge appeal panels which were presiding over cases at the Palace of Justice today.

They also noted that Ramly should have only granted an interim stay and not a permanent one.

Given the gravity of the case and political ramifications, several lawyers noted that the court registrar should have ensured that Zambry’s stay application was heard by a three-judge panel, and not one of the most junior appeal court judges.

Veteran Opposition politician Lim Kit Siang said that “the stay given by a single judge of the Court of Appeal “stayed” Nizar from taking back his lawful and legitimate office as Perak Mentri, but it did not overturn the

High Court decision and could not be taken to mean that Zambry can continue to be illegal and illegitimate Perak MB.

“The lawyers I spoke to in the past few hours are shocked at the Court of Appeal single-judge ’stay’ decision.’’

His emphasis on the the phrase “single-judge Court of Appeal” is deliberate, denoting a disbelief that one of the most controversial cases to pass through the court system this year did not go before a full panel of appeal judges.

MB luar tabii akur keputusan Mahkamah?

UNTUK hari ini dan sehingalah Mahkamah Persekutuan memutuskan rayuan dibuat Zambry Abdul Kadir, Mohamad Nizar Jamaluddin adalah Menteri Perak yang sah. Beliau juga berhak mendapat semula gelaran Yang Amat Berhormat (YAB) yang yang diberikan kepada seseorang Menteri Besar berikutan keputusan Mahkamah Tinggi yang mengistyharkan Nizar adalah Menteri Besar Perak yang sah sekejap tadi.

Walaupun Zambry Abdul Kadir merayu supaya menangguhkan pelaksanaan keputusan sementara pihaknya mengemukakan rayuan, namun dengan keputusan itu mengesahkan bahawa setakat hari ini Nizar adalah MB yang sah.

Keputusan itu juga menyebabkan Zambry tidak berhak untuk menjalankan apa-apa urusan dan tugas sebagai Menteri Besar.

Keputusan Mahkamah Tinggi itu memberi kemenangan kepada Nizar dan juga rakyat yang selama ini menyokong tindakan Nizar dan beranggapan perlantikan Zambry sebagai MB tidah sah. Pastinya keputusan berpihak kepada rakyat itu disambut dengan penuh kegembiraan.

Keputusan itu dibaca oleh Hakim Mahkamah Tinggi Kuala Lumpur, Datuk Abdul Aziz Abdul Rahim yang mula membacakan kertas penghakiman bermula kira-kira 2.30 petang. Kedua Menteri Besar itu juga hadir di mahkamah.

Sudah pasti dengan keputusan Mahkamah Tinggi itu menyebabkan segala keputusan berhubung pentadbiran kerajaan Perak dilakukan Zambry sejak lebih dua bulan lalu menjadi pertikaian. Ianya akan berhadapan dengan implikasi undang-undang. Demikian juga dengan perjalanan sidang DUN yang kecoh beberapa hari lalu mungkin tidak sah.

Bagaimana pun disebabakan keputusan itu dirayu di Mahkamah Persekutuan kemelut politik tempoyak di Perak itu masih belum muktamad. Seperti mana dibayangkan sebelum ini oleh banyak pihak kemelut politik di Perak tidak akan selesai selagi Dewan Undangan Negeri (DUN) Perak tidak dibubarkan dan satu plihan raya baru diadakan.

Sebagai rekod Nizar, 52 dilantik menjadi Menteri Besar pada 17 Mac 2008 setelah Pakatan Rakyat yang terdiri daripada Pas, DAP dan PKR mendapat majoriti dalam pilihan raya berkenaan. Sultan Azlan Shah perkenan untuk melantik Nizar sbagai MB.

Bagaimana pun kerusi MB Nizar itu dirampas oleh satu kudeta oleh BN pada 4 Februari lalu. Rampasan kuasa ini dengan bantuan tiga Adun yang sebelum ini berpihak kepada Pakatan Rakyat lari kepada BN.

Raja Nazrin agrees to meet Nizar

raja-nazrin-shahThe Regent of Perak Raja Nazrin Shah has agreed to see Datuk Seri Nizar Jamaluddin, who was today declared the legitimate mentri besar of Perak by a Kuala Lumpur High Court.

Nizar will meet the Regent at 8.30am tomorrow to ask for the dissolution of the Perak state legislative assembly to pave the way for a fresh state election, according to several Pakatan Rakyat (PR) leaders including Sungkai assemblyman S. A. Sivanesan.

“I just talked with Nizar and he confirmed to me that he has secured an audience with the Regent at 8.30am,” Sivanesan told The Malaysian Insider.

“Nizar will request for dissolution of the legislature for a fresh election,” Sivanesan said adding he hoped the request is not rejected. “Nizar has the legitimate right now that he is the legitimate mentri besar to request for dissolution.”

Sultan Azlan Shah, PR leaders said, is in the United States.

PR assemblymen are also meeting from 11pm tonight to strategise their plans for Tuesday even as the Barisan Nasional (BN) rush to court on tomorrow to set aside the declaration that Nizar is the rightful mentri besar.

Tomorrow is set to be a climatic day with the royal audience, BN rushing to court and Nizar trying to enter his office with police already surrounding the state secretariat building since 4pm today.

Justice Abdul Aziz Rahim declared today that a mentri besar can only be removed by a vote of confidence on the floor of the state assembly.

Nizar declared Menteri Besar ! Horray to democracy!

NIZAR JAMALUDDINRIDING HIGH, AGAIN: Datuk Nizar Jamaluddin smiles confidently before entering the High Court chambers in Kuala Lumpur to hear the verdict of the suit to declare who would be the legitimate Perak Menteri Besar. His confidence was justified: the court ruled him as the legitimate MB and he should regain his office soon after the court denied rival MB, Datuk Dr Zambry Kadir, his application for a stay of execution.

The High Court today declared Datuk Nizar Jamaluddin as the legitimate Menteri Besar of Perak and his bid to regain office will come sooner than expected after the same court denied the application of rival MB, Datuk Dr Zambry Abdul Kadir, for a apply for a stay pending an appeal.
